1. About these terms

These Terms of Use (the "Terms") govern your access to and use of the GulfGrow mobile app and the gardenaffairs.me/gulfgrow website (together, the "Service") published by Garden Affairs, a company based in the Kingdom of Bahrain ("we", "us", "our"). By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

GulfGrow is a planting calendar and care guide app for the Arabian Gulf region, providing crop information, sowing schedules, watering and feeding guidance, pest information, and an FAQ — in English and Arabic. The Service is provided as a reference tool; outcomes in your garden depend on factors outside our control.

3. Eligibility

You must be at least 13 years old (or the age of digital consent in your country, if higher) to use the Service. If you use the Service on behalf of a household or organisation, you confirm you are authorised to do so.

4. Subscription and billing

GulfGrow is a subscription service. We currently offer:

4.1 Auto-renewal disclosure (Apple App Store and Google Play)

Payment will be charged to your Apple ID or Google account at confirmation of purchase. The subscription automatically renews for the same period (monthly or annual) at the then-current price unless auto-renewal is turned off at least 24 hours before the end of the current period.

Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscription by going to your App Store or Google Play account settings after purchase. Any unused portion of a free trial period (if offered) will be forfeited when you purchase a subscription.

4.2 Refunds

Refunds, where they exist, are handled by Apple or Google according to their respective policies — not by us. We are not able to issue refunds for App Store or Play Store purchases. To request a refund, use Apple's "Report a Problem" page (reportaproblem.apple.com) or your Google Play order history.

4.3 Price changes

We may change subscription prices for future renewal periods. If we do, we will notify you in advance through the app or by email (where applicable) before the change takes effect. You may cancel before the new price applies.

All content in the Service — text, photographs, illustrations, code, design, and the GulfGrow and Garden Affairs names and logos — is owned by Garden Affairs or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial use, subject to these Terms. We retain all rights not expressly granted.

7. Disclaimer

GulfGrow is a reference and planning tool. Gardening outcomes depend on weather, soil, water quality, pest pressure, microclimate, your specific cultivars, and the care you apply. The information in the Service is provided as-is, without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that any specific crop, variety, or schedule will succeed in your garden.

8. Limitation of liability

To the maximum extent permitted by law, Garden Affairs and its principals, employees, and contractors shall not be liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or relating to your use of the Service, including loss of plants, crops, time, or profits. Our total aggregate liability for any claim arising under these Terms shall not exceed the amount you paid us in subscription fees in the 12 months preceding the claim.

9. Third-party platforms

The Service is distributed through the Apple App Store and Google Play, and uses Google Cloud / Firebase for backend hosting. Your use of those platforms is also subject to their own terms. We are not responsible for those platforms' availability or behaviour.

10. Changes to the Service

We may add, remove, or change features at any time. We may also discontinue the Service entirely on reasonable notice. If we discontinue the Service, we will stop charging subscription fees and you will keep access until the end of any period you have already paid for.

11. Termination

We may suspend or terminate your access to the Service if you materially breach these Terms or use the Service in a way that creates risk for us or other users. You may stop using the Service at any time by deleting the app and cancelling your subscription via your device's subscription settings.

12. Governing law and disputes

These Terms are governed by the laws of the Kingdom of Bahrain. Any dispute arising out of these Terms shall be submitted to the competent courts of Bahrain, without prejudice to any mandatory consumer-protection rights you may have in your country of residence.

تحكم شروط الاستخدام هذه ("الشروط") وصولك إلى تطبيق GulfGrow الجوّال وموقع gardenaffairs.me/gulfgrow واستخدامك لهما (يُشار إليهما معًا بـ"الخدمة")، الذي تنشره شركة Garden Affairs، وهي شركة مقرّها مملكة البحرين ("نحن"، "لنا"). بتنزيل الخدمة أو تثبيتها أو استخدامها، فإنك توافق على هذه الشروط. إن لم توافق، فلا تستخدم الخدمة.

2. الخدمة

GulfGrow تطبيق تقويم زراعة ودليل عناية لمنطقة الخليج العربي، يقدّم معلومات عن المحاصيل، وجداول البذر، وإرشادات الريّ والتسميد، ومعلومات عن الآفات، وأسئلة شائعة — باللغتين العربية والإنجليزية. الخدمة أداة مرجعية، ونتائج حديقتك تعتمد على عوامل خارجة عن سيطرتنا.

3. الأهلية

يجب أن يكون عمرك 13 عامًا على الأقل (أو سن الموافقة الرقمية في بلدك إن كان أعلى) لاستخدام الخدمة. إذا استخدمت الخدمة نيابة عن أسرة أو منظمة، فإنك تؤكّد أنك مفوّض بذلك.

4. الاشتراك والفوترة

GulfGrow خدمة بالاشتراك. نقدّم حاليًا:

  • الاشتراك الشهري: 3.99 دولار أمريكي شهريًا
  • الاشتراك السنوي: 39.99 دولار أمريكي سنويًا

4.1 إفصاح التجديد التلقائي (متجر Apple وGoogle Play)

سيتم خصم المبلغ من حساب Apple ID أو Google الخاص بك عند تأكيد الشراء. يتجدّد الاشتراك تلقائيًا للفترة نفسها (شهرية أو سنوية) بالسعر الساري حينها، ما لم يتم إيقاف التجديد التلقائي قبل 24 ساعة على الأقل من نهاية الفترة الحالية.

يتم خصم رسوم التجديد من حسابك خلال 24 ساعة قبل نهاية الفترة الحالية. يمكنك إدارة الاشتراك وإلغاؤه من إعدادات حسابك في متجر Apple أو Google Play بعد الشراء. تسقط أي فترة تجريبية مجانية غير مستخدمة (إن وُجدت) عند شراء الاشتراك.

4.2 الاسترداد

يتم التعامل مع طلبات الاسترداد، إن وُجدت، عبر Apple أو Google وفق سياساتهما — وليس من قِبَلنا. لا نستطيع إصدار مبالغ مستردّة لمشتريات متجر التطبيقات أو Play. لطلب الاسترداد، استخدم صفحة Apple "الإبلاغ عن مشكلة" (reportaproblem.apple.com) أو سجلّ الطلبات في Google Play.

4.3 تغييرات الأسعار

قد نغيّر أسعار الاشتراك لفترات التجديد المستقبلية. سنُعلمك مسبقًا عبر التطبيق أو البريد الإلكتروني (عند الاقتضاء) قبل سريان التغيير. يمكنك الإلغاء قبل تطبيق السعر الجديد.

5. الاستخدام المقبول

توافق على ألّا:

  • تقوم بهندسة عكسية أو فكّ تجميع التطبيق أو محاولة استخراج شفرته المصدرية، إلا في الحدود التي يسمح بها القانون.
  • تستخدم الخدمة لانتهاك أي قانون أو لائحة معمول بها.
  • تتدخّل في عمل الخدمة أو خوادمها أو تعطّلها.
  • تعيد بيع الوصول إلى الخدمة أو تمنحه ترخيصًا من الباطن أو تعيد توزيعه.
  • تجمع المحتوى بكميات كبيرة أو تعيد نشره من الخدمة دون إذن خطّي منا.

6. الملكية الفكرية

جميع محتوى الخدمة — النصوص، والصور، والرسوم التوضيحية، والشيفرة، والتصميم، وأسماء وشعارات GulfGrow وGarden Affairs — مملوكة لشركة Garden Affairs أو مرخّصيها ومحمية بحقوق التأليف والنشر والعلامات التجارية وغيرها من القوانين. نمنحك ترخيصًا محدودًا، شخصيًا، غير حصري، غير قابل للتحويل، وقابلًا للإلغاء، لاستخدام الخدمة لأغراض شخصية وغير تجارية، وفق هذه الشروط. تحتفظ الشركة بجميع الحقوق غير الممنوحة صراحةً.

7. إخلاء المسؤولية

GulfGrow أداة مرجعية وتخطيطية. تعتمد نتائج البستنة على الطقس والتربة وجودة الماء وضغط الآفات والمناخ المحلي والأصناف المستخدمة ومستوى العناية. تُقدَّم المعلومات في الخدمة كما هي، بدون أي ضمان من أي نوع، صريحًا أو ضمنيًا، بما في ذلك ضمانات قابلية التسويق أو الملاءمة لغرض معين أو عدم الانتهاك. لا نضمن نجاح أي محصول أو صنف أو جدول معيّن في حديقتك.

8. حدود المسؤولية

إلى أقصى حد يسمح به القانون، لن تكون شركة Garden Affairs ومسؤولوها وموظفوها ومتعاقدوها مسؤولين عن أي أضرار غير مباشرة أو عرضية أو تبعية أو خاصة أو رادعة ناشئة عن استخدامك للخدمة أو متعلقة به، بما في ذلك فقدان النباتات أو المحاصيل أو الوقت أو الأرباح. لن يتجاوز إجمالي مسؤوليتنا عن أي مطالبة بموجب هذه الشروط المبلغ الذي دفعته لنا كرسوم اشتراك خلال 12 شهرًا قبل المطالبة.

9. منصّات الأطراف الثالثة

تُوزَّع الخدمة عبر متجر Apple وGoogle Play، وتستخدم Google Cloud / Firebase للاستضافة. يخضع استخدامك لتلك المنصّات أيضًا لشروطها. لسنا مسؤولين عن توفّر تلك المنصّات أو سلوكها.

10. تغييرات الخدمة

قد نضيف ميزات أو نزيلها أو نغيّرها في أي وقت. كما قد نوقف الخدمة بالكامل بإشعار مسبق معقول. إذا أوقفنا الخدمة، فسنوقف فرض رسوم الاشتراك، وستبقى لك صلاحية الوصول حتى نهاية أي فترة دفعت ثمنها.

11. الإنهاء

قد نعلّق وصولك إلى الخدمة أو ننهيه إذا خالفت هذه الشروط مخالفة جوهرية أو استخدمت الخدمة بطريقة تُعرّضنا أو تُعرّض المستخدمين الآخرين للخطر. يحقّ لك التوقّف عن استخدام الخدمة في أي وقت بحذف التطبيق وإلغاء الاشتراك من إعدادات الاشتراكات في جهازك.

12. القانون الحاكم والنزاعات

تخضع هذه الشروط لقوانين مملكة البحرين. تُحال أي نزاعات ناشئة عن هذه الشروط إلى المحاكم المختصة في البحرين، دون المساس بأي حقوق إلزامية لحماية المستهلك قد تتمتّع بها في بلد إقامتك.
