1. About these terms

These Terms of Use (the "Terms") govern your access to and use of the Gulf Plants mobile app and the gardenaffairs.me/gulfplants website (together, the "Service") published by Garden Affairs, a company based in the Kingdom of Bahrain ("we", "us", "our"). By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

Gulf Plants is a bilingual reference app for the 143 most common landscape plants of the Arabian Gulf region. It provides plant names (English, Arabic, botanical), photographs, descriptions, care information (water, sun, heat, blooming season, country suitability), toxicity flags, and uses-in-landscapes notes — in English and Arabic. The Service is provided as a reference tool. Outcomes in your garden depend on factors outside our control.

3. Eligibility

You must be at least 13 years old (or the age of digital consent in your country, if higher) to use the Service. If you use the Service on behalf of a household or organisation, you confirm you are authorised to do so.

4. Subscription and billing

Gulf Plants is a subscription service. We currently offer:

4.1 Auto-renewal disclosure (Apple App Store and Google Play)

Payment will be charged to your Apple ID or Google account at confirmation of purchase. The subscription automatically renews for the same period (monthly or annual) at the then-current price unless auto-renewal is turned off at least 24 hours before the end of the current period.

Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscription by going to your App Store or Google Play account settings after purchase. Any unused portion of a free trial period (if offered) will be forfeited when you purchase a subscription.

4.2 Refunds

Refunds, where they exist, are handled by Apple or Google according to their respective policies — not by us. We are not able to issue refunds for App Store or Play Store purchases. To request a refund, use Apple's "Report a Problem" page (reportaproblem.apple.com) or your Google Play order history.

4.3 Price changes

We may change subscription prices for future renewal periods. If we do, we will notify you in advance through the app or by email (where applicable) before the change takes effect. You may cancel before the new price applies.

All original content in the Service — the bilingual plant index, descriptions, care data tables, code, design, and the Gulf Plants and Garden Affairs names and logos — is owned by Garden Affairs or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial use, subject to these Terms. We retain all rights not expressly granted.

7. Photo licenses (CC-BY)

Gulf Plants includes 26 photographs licensed from iNaturalist contributors under Creative Commons Attribution (CC-BY) licenses. These photographs:

The remaining 397 photographs are extracted from a public Bahrain reference document and are presented in the Service for educational and reference purposes. Any commercial reuse of those images is the responsibility of the user. The full list of CC-BY photographer credits is available on the Disclaimer page and inside the app under About → Attributions.

8. Plant data accuracy and toxicity

Gulf Plants is a reference, not professional advice. Plant identification, care information, and toxicity flags are best-effort estimates compiled from public horticultural sources. They are not a substitute for advice from a qualified horticulturist, veterinarian, or poison control center.

Toxicity entries marked "unknown" mean we have not been able to confirm a plant's safety profile. Unknown is not the same as safe. If a person or animal has ingested a plant and you are unsure, contact your local poison control service or a veterinarian immediately — do not rely on this app to make that decision.

Many care-data fields are marked as category defaults rather than species-specific facts. The app surfaces these source flags so you can tell when a value is conservative-general vs. species-precise. We make no warranty that any care recommendation will succeed in your specific microclimate.

9. Disclaimer

The information in the Service is provided as-is, without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that any specific plant, identification, or care recommendation will succeed or apply in your situation. The full disclaimer is available at gardenaffairs.me/gulfplants/disclaimer.

10. Limitation of liability

To the maximum extent permitted by law, Garden Affairs and its principals, employees, and contractors shall not be liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or relating to your use of the Service, including loss of plants, time, profits, or any consequences of plant misidentification, ingestion, allergic reaction, or care recommendations followed. Our total aggregate liability for any claim arising under these Terms shall not exceed the amount you paid us in subscription fees in the 12 months preceding the claim.

11. Third-party platforms

The Service is distributed through the Apple App Store and Google Play, and uses Google Cloud / Firebase for plant photo hosting and crash diagnostics. Your use of those platforms is also subject to their own terms. We are not responsible for those platforms' availability or behaviour.

12. Changes to the Service

We may add, remove, or change features at any time. We may also discontinue the Service entirely on reasonable notice. If we discontinue the Service, we will stop charging subscription fees and you will keep access until the end of any period you have already paid for.

13. Termination

We may suspend or terminate your access to the Service if you materially breach these Terms or use the Service in a way that creates risk for us or other users. You may stop using the Service at any time by deleting the app and cancelling your subscription via your device's subscription settings.

14. Governing law and disputes

These Terms are governed by the laws of the Kingdom of Bahrain. Any dispute arising out of these Terms shall be submitted to the competent courts of Bahrain, without prejudice to any mandatory consumer-protection rights you may have in your country of residence.

تحكم شروط الاستخدام هذه ("الشروط") وصولك إلى تطبيق نباتات الخليج الجوّال وموقع gardenaffairs.me/gulfplants واستخدامك لهما (يُشار إليهما معًا بـ"الخدمة")، الذي تنشره شركة Garden Affairs، وهي شركة مقرّها مملكة البحرين ("نحن"، "لنا"). بتنزيل الخدمة أو تثبيتها أو استخدامها، فإنك توافق على هذه الشروط. إن لم توافق، فلا تستخدم الخدمة.

2. الخدمة

نباتات الخليج تطبيق مرجعي ثنائي اللغة لـ 143 نبتة من أكثر نباتات تنسيق الحدائق شيوعًا في منطقة الخليج العربي. يقدّم أسماء النباتات (بالإنجليزية والعربية والاسم العلمي)، والصور، والأوصاف، ومعلومات العناية (الماء، الشمس، الحرارة، موسم الإزهار، ملاءمة الدول)، وإشارات السمّية، وملاحظات الاستخدام في تنسيق الحدائق — باللغتين العربية والإنجليزية. الخدمة أداة مرجعية. تعتمد نتائج حديقتك على عوامل خارجة عن سيطرتنا.

3. الأهلية

يجب أن يكون عمرك 13 عامًا على الأقل (أو سن الموافقة الرقمية في بلدك إن كان أعلى) لاستخدام الخدمة. إذا استخدمت الخدمة نيابة عن أسرة أو منظمة، فإنك تؤكّد أنك مفوّض بذلك.

4. الاشتراك والفوترة

نباتات الخليج خدمة بالاشتراك. نقدّم حاليًا:

  • الاشتراك الشهري: 5.99 دولار أمريكي شهريًا
  • الاشتراك السنوي: 59.99 دولار أمريكي سنويًا

4.1 إفصاح التجديد التلقائي (متجر Apple وGoogle Play)

سيتم خصم المبلغ من حساب Apple ID أو Google الخاص بك عند تأكيد الشراء. يتجدّد الاشتراك تلقائيًا للفترة نفسها (شهرية أو سنوية) بالسعر الساري حينها، ما لم يتم إيقاف التجديد التلقائي قبل 24 ساعة على الأقل من نهاية الفترة الحالية.

يتم خصم رسوم التجديد من حسابك خلال 24 ساعة قبل نهاية الفترة الحالية. يمكنك إدارة الاشتراك وإلغاؤه من إعدادات حسابك في متجر Apple أو Google Play بعد الشراء. تسقط أي فترة تجريبية مجانية غير مستخدمة (إن وُجدت) عند شراء الاشتراك.

4.2 الاسترداد

يتم التعامل مع طلبات الاسترداد، إن وُجدت، عبر Apple أو Google وفق سياساتهما — وليس من قِبَلنا. لا نستطيع إصدار مبالغ مستردّة لمشتريات متجر التطبيقات أو Play. لطلب الاسترداد، استخدم صفحة Apple "الإبلاغ عن مشكلة" (reportaproblem.apple.com) أو سجلّ الطلبات في Google Play.

4.3 تغييرات الأسعار

قد نغيّر أسعار الاشتراك لفترات التجديد المستقبلية. سنُعلمك مسبقًا عبر التطبيق أو البريد الإلكتروني (عند الاقتضاء) قبل سريان التغيير. يمكنك الإلغاء قبل تطبيق السعر الجديد.

5. الاستخدام المقبول

توافق على ألّا:

  • تقوم بهندسة عكسية أو فكّ تجميع التطبيق أو محاولة استخراج شفرته المصدرية، إلا في الحدود التي يسمح بها القانون.
  • تستخدم الخدمة لانتهاك أي قانون أو لائحة معمول بها.
  • تتدخّل في عمل الخدمة أو خوادمها أو تعطّلها.
  • تعيد بيع الوصول إلى الخدمة أو تمنحه ترخيصًا من الباطن أو تعيد توزيعه.
  • تجمع المحتوى بكميات كبيرة أو تعيد نشره من الخدمة دون إذن خطّي منا.
  • تعيد نشر الصور من الخدمة إلا بما تسمح به تراخيصها الفردية (انظر القسم 7).

6. الملكية الفكرية

جميع المحتوى الأصلي في الخدمة — فهرس النباتات ثنائي اللغة، والأوصاف، وجداول العناية، والشيفرة، والتصميم، وأسماء وشعارات نباتات الخليج وGarden Affairs — مملوكة لشركة Garden Affairs أو مرخّصيها ومحمية بحقوق التأليف والنشر والعلامات التجارية وغيرها من القوانين. نمنحك ترخيصًا محدودًا، شخصيًا، غير حصري، غير قابل للتحويل، وقابلًا للإلغاء، لاستخدام الخدمة لأغراض شخصية وغير تجارية، وفق هذه الشروط. تحتفظ الشركة بجميع الحقوق غير الممنوحة صراحةً.

7. تراخيص الصور (CC-BY)

يتضمّن تطبيق نباتات الخليج 26 صورة مرخّصة من مساهمي iNaturalist بموجب رخصة المشاع الإبداعي - النسبة (CC-BY). هذه الصور:

  • تُنسب بوضوح إلى مصوّريها داخل التطبيق في كل عرض.
  • تبقى ملكًا لمصوّريها الأصليين.
  • يمكن إعادة استخدامها خارج الخدمة وفق شروط رخصها CC-BY، شريطة الاستمرار في نسبتها للمصوّر.

الصور الـ 397 المتبقية مأخوذة من وثيقة مرجعية بحرينية عامة، وتُعرض في الخدمة لأغراض تعليمية ومرجعية. أي إعادة استخدام تجاري لتلك الصور هي مسؤولية المستخدم. تتوفر القائمة الكاملة لاعتماد المصوّرين CC-BY في صفحة إخلاء المسؤولية وداخل التطبيق ضمن "حول التطبيق ← الاعتمادات".

8. دقة بيانات النباتات والسمّية

نباتات الخليج مرجع وليس استشارة مهنية. أسماء النباتات ومعلومات العناية وإشارات السمّية تقديرات مبذولة بحسن نية، مُجمَّعة من مصادر بستنية عامة. ليست بديلاً عن استشارة بستاني مؤهّل أو طبيب بيطري أو مركز السموم.

إشارات السمّية الموسومة بـ "غير معروفة" تعني أنّنا لم نتمكّن من تأكيد ملف السلامة للنبات. "غير معروف" ليس مرادفًا لـ "آمن". إذا ابتلع شخص أو حيوان نبتة وكنت غير متأكد، فاتصل فورًا بمركز السموم المحلي أو طبيب بيطري — لا تعتمد على هذا التطبيق لاتخاذ ذلك القرار.

كثير من حقول العناية موسومة بـ "افتراضية للفئة" بدلاً من حقائق خاصة بالنوع. يُظهر التطبيق هذه الإشارات لتعرف متى تكون القيمة محافظة عامة ومتى تكون دقيقة على مستوى النوع. لا نضمن نجاح أي توصية عناية في مناخك المحلي.

9. إخلاء المسؤولية

تُقدَّم المعلومات في الخدمة كما هي، بدون أي ضمان من أي نوع، صريحًا أو ضمنيًا، بما في ذلك ضمانات قابلية التسويق أو الملاءمة لغرض معين أو عدم الانتهاك. لا نضمن نجاح أي نبتة أو تعريف أو توصية عناية محدّدة في موقفك. إخلاء المسؤولية الكامل متاح على gardenaffairs.me/gulfplants/disclaimer.

10. حدود المسؤولية

إلى أقصى حد يسمح به القانون، لن تكون شركة Garden Affairs ومسؤولوها وموظفوها ومتعاقدوها مسؤولين عن أي أضرار غير مباشرة أو عرضية أو تبعية أو خاصة أو رادعة ناشئة عن استخدامك للخدمة أو متعلقة به، بما في ذلك فقدان النباتات أو الوقت أو الأرباح أو أي عواقب لتعريف خاطئ لنبات أو ابتلاعه أو رد فعل تحسسي أو اتباع توصيات عناية. لن يتجاوز إجمالي مسؤوليتنا عن أي مطالبة بموجب هذه الشروط المبلغ الذي دفعته لنا كرسوم اشتراك خلال 12 شهرًا قبل المطالبة.

11. منصّات الأطراف الثالثة

تُوزَّع الخدمة عبر متجر Apple وGoogle Play، وتستخدم Google Cloud / Firebase لاستضافة صور النباتات وتشخيصات الأعطال. يخضع استخدامك لتلك المنصّات أيضًا لشروطها. لسنا مسؤولين عن توفّر تلك المنصّات أو سلوكها.

12. تغييرات الخدمة

قد نضيف ميزات أو نزيلها أو نغيّرها في أي وقت. كما قد نوقف الخدمة بالكامل بإشعار مسبق معقول. إذا أوقفنا الخدمة، فسنوقف فرض رسوم الاشتراك، وستبقى لك صلاحية الوصول حتى نهاية أي فترة دفعت ثمنها.

13. الإنهاء

قد نعلّق وصولك إلى الخدمة أو ننهيه إذا خالفت هذه الشروط مخالفة جوهرية أو استخدمت الخدمة بطريقة تُعرّضنا أو تُعرّض المستخدمين الآخرين للخطر. يحقّ لك التوقّف عن استخدام الخدمة في أي وقت بحذف التطبيق وإلغاء الاشتراك من إعدادات الاشتراكات في جهازك.

14. القانون الحاكم والنزاعات

تخضع هذه الشروط لقوانين مملكة البحرين. تُحال أي نزاعات ناشئة عن هذه الشروط إلى المحاكم المختصة في البحرين، دون المساس بأي حقوق إلزامية لحماية المستهلك قد تتمتّع بها في بلد إقامتك.
